WEDNESDAY, AUGUST 2 5, 1 9 9 9 DETROIT FREE PRESS 5B Barden appealing casino suit dismissal OBITUARIES He says preferences were unconstitutional DETROIT Bernard Landuyt: Shared inspiration with students trict Court in Detroit. Barden's $100-million lawsuit argued that the casino licensing process was unconstitutional because it granted preferences to the MotorCity and Greektown casino groups. U.S. District Judge Gerald Rosen ruled July 22 that Barden couldn't sue because he waived that right when he applied for a casino license. But Rosen noted in his 66-page opinion that the casino process, with its preferences for casino groups who pushed for statewide approval of casinos, was legally risky and invited challenge in the courts.

A mayoral spokesman said he's disappointed but not surprised that Barden is appealing. "This latest move is not altogether surprising, given the single-minded focus that we've witnessed in the past," said Mayor Dennis Archer's press secretary, Greg Bowens. Barden has challenged Archer's casino choices through a referendum and an attempted recall of the mayor. MGM Grand Detroit Casino opened its temporary facility in downtown Detroit July 29. The MotorCity and Greektown casinos are nearing completion of their temporary casinos.

"The appeal is not going to interfere with any of our plans to complete construction of the Greektown casino by mid- to late November," said John Hatch, spokesman for the Greektown ca sino. Spokesmen for MGM Grand and MotorCity declined to comment. The appeal will be heard by the 6th Circuit of the U.S. Court of Appeals in Cincinnati. Earlier this year, that appeals court reinstated a lawsuit filed by the Lac Vieux Desert tribe that also challenged Detroit's casino process.

A federal judge in Marquette threw out that lawsuit two years ago, but the appeals court said the tribe had constitutional issues and the lawsuit should go forward. TINA LAM can be reached at 313-223-4407. Staff writer Darci McConnell contributed to this report. By TINA LAM FREE PRtSS STAFF RITER Don Barden, who was turned down for a Detroit casino, is appealing a federal judge's decision to throw out a lawsuit he filed challenging Detroit's casino process. Barden was out of town and could not be reached Tuesday.

A notice of the appeal, signed by Barden attorney Robert Carson, was filed last week in U.S. Dis year friendship with his former professor, called Dr. Landuyt "a student's professor." "He didn't measure the students against some cold objective standard, he measured them against their effort, desire and motivation," Page said. "He saw that as his mission, to help the students succeed." Page said Dr. Landuyt's modest upbringing in rural Illinois and experiences during the Depression taught him the value of an education.

He said Dr. Landuyt measured himself by how well he helped his students obtain their degrees. "I don't think that any student came out of his class that didn't feel that warmth or sincerity or motivation to help the students succeed," Page said. After he retired, Dr. Landuyt continued teaching management and economics at Madonna University.

Several years ago, the university's business school honored him by naming its highest academic award after Dr. Landuyt and his late wife, Meta. In addition to his work at the two local universities, Dr. Landuyt worked for Western Illinois State University, the University of Iowa, Illinois College, Princeton University, the Chrysler Institute, the University of Michigan and Central Michigan University. Visitation will be from 4 to 9 p.m.

today at A. J. Desmond Sons Funeral Home, 32515 Woodward, Royal Oak. A funeral will be at 9 a.m. Thursday at Our Lady Queen of Martyrs Church, 32340 Pierce, Beverly Hills.

Entombment will be in Holy Sepulchre Cemetery in South-field. MX. ELRICK can be reached at 313-223-4456 or elrickfafreepress.com. By M. L.
