that he ap point the necessary committees to do the work and guaranteed that with the assistance of the Vice CommodOra tho regatta could bo car ded to a successful end Mr Lesher thought the regatta should be carried out as originally intended and Mr was of the same mind Commodore Allen called upon tho gentlemen present to signify their willingness to go upon tjha committees and work forthesuccess of the' regatta In response Messrs Molony Eddy Ralph Harsha Lesher and others sig nified their willingness to do such work Commodore Allen then asked Mr Liggett if the Committee would guarantee sufficient sum of money to conduct the regatta to a successful issue Mr Liggett could not speak for the com mittee but he thought from expressions made by the members of the committee that there would be nd tronble about raising $1000 and possibly $1200 Mr thought there was no trouble about raising the money and asked that talk about it be stopped Mr Harsha called for the question and Mr Lesher asked for an expression from the Commodore before voting on the question Com Allen said he thought that there was but little chance for a successful regatta' but he would hot pit his views against those of the Committee and a good majority of the boating men' He wished it distinctly un derstood however that in case of failure he would not take any of the blame The question was then voted upon and it was unanimously decided to hold a regatta as originally arranged Com' Allen thereupon appointed TMessrs Moran Smith and Keene a Committee' on Grand Stand and the committee re quested your journal the state ment appeared that a young man by the name of John Lacourse had been arrested in your city at my instigation for obtaining false from my agency of the Cana dian Express Company here a parcel of cloth ing uxn which there was a certain amount to be collected upon delivery which amount he did not pay I was temporarily absent from my office at the time and I find upon investigation that the charge so made was not true and should not have been made Mr Lacourse was given the parcel by a junior clerk in office without any demand beings made for more than the freight viz twenty five cents i My son then in charge of the office thoughtlessly and from want of experience in such matters sent the telegram complained of to the authorities in Detroit and upon Mr Lacourse being told for the first time that there was a collection of $26 on the goods he had received the amount was at once paid I make this correction in justice to the young man and shall be obliged by residents on Mad ison avenue from snatching for their own private uses 128 feet of that magnificent street 1 a storm of indignation against the promoters of the scheme uprose The Common Council saw the matter in the same light "in which the general public saw it a report of the Committee on Streets denouncing it as un lawful and recommending the indefinite post ponement of the ordinance which Brown then City Attorney had prepared in accordance with the demands of the Madison avenue managers But notwithstanding that reaming crushing defeat of the schemers they were noii in reality defeated Madison avenue re spectfully report: A The avenue in question is 200 feet wide and ex tends from Grand Circus Perk to Randolph street Stated in detail the petitioners ask that the road way of the avenue shall be forty feet in width that on either side ana next thereto there shall be a grass plat eight feet vtfcle next to which there shall be a side walk also Eight feet wide the re maining portions of the street to be inclosed by a fence for the purpose ot protecting grass sbrub bery and trees to be planted therein with walks for the convenience of householders from the linea pjio lv permit the proposed change in the condition pf the avenue but in a recent com muncatlon from one ot the petitioners a promi nent member of the legal profession it is set forth that in this we mistake: that the provision of the charter which gives to the Common Council power to prescribe and regulate the manner in which the highways streets avenues lanes alleys public grounds and spaces within said city shall be used and enjoyed: to direct and regulate the plant ing and provide for the preservation of ornamental trees confers sufficient authority to grant the desired permission and we are informed by him that like views are entertained by other at torneys The petitioner is supposed to be learned in the law and we have great respect for his opinion and we shall not attempt to argue questions of law with those who have successfullyjpropounded their views of legal ques tions before the highest judicial tribunal In the State But If prominent members of the bar deem it not improper as recently to publicly dissent from the Opinions and decisions of our Suprema Court your committee may be pardoned if In mat ters aenumding their consideration they shall presuma to adhere to their own convictions of the law We are coastrained to believe that the Council has no power to grant permission to adja cent lot owners td inclose and virtually attach to their lots considerable portions public ac quired by the act Of dedication of streets vested rights protected by the Constitution of the Lnited States and It is not therefore competent I for the legislative power of the State much less of the Common Council of the city to pass any act or ordinance which shall in any wise impair or defeatthose rights The powers of the city authorities are restricted to the regulation of the streets Th is is a necessary power and one which if wisely ex erted cannot fall to prove highly beneficial to the community But the power to regulate streets does not include the power to pass ordinances which shall affect injuriously public or private rights The Common Council is to some extent the guardian of those rights As such it becomes them duly to employ all the A powers with which they are vested to purify the streets of the city and to cause all obstructions not warranted by law or necessity to be removed The adoption of such a policy will remedy the mischiefs that have grown up under a conrse of legislation by which the rigid of the public have been made etibeefyierd to the convenience or cupidity cf (See 1 Michigan Reports But it we are mistaken in our opinion of law It is presented with great deference it vet does not follow that we should accord the permis sion desired It granted it is stipulated that it mar terminate at the pleasure of the Council Will there ever be a time when the petitioners will ba less urgent to retain the prlvilerfM than they now are to acquire them? If a portion of the high way is to be made an elegant gross lawn beautified by shrubbery and ornamented with trees those who shall make it so or their suc cessors will with reason insist that the mainten ance of the fence inclosing the same is necessary to the continuance of such ornamentation Our experience has been that where for like or other purposes portions of streets or avenues have once been taken from public use the public have vir tually forever ceased to have any rights thereto or control of the same And what would be the re sult if some of the lot owners would voluntarily abandon the privileges sought and others retain them a portion of such inclosures were re moved and the remainder continued? It will be seen that it is proposed to take from the public use and occupancy about 128 feet of the width of the street or more than one half Will the growth of the grass and shrubbery and the public for being debarred from the ordinary use of bo large a portion of a public ave nue? The public are to ba permitted to look upon the beautiful a privilege truly but we most respectfully submit that it is hardly equivalent to the privileges and rights to be with drawn from them We are led to ask if the provis ion tor wide streets and avenues of which we have hitherto been So proud was after all a mistake If it was an'error to consider them desirable? Have net large sums been paid for widening streets when such widening has been declared by juries a public necessity?
