Missouri This is the famous Maxwell Preller murder case Brooks or Maxwell the plaintiff in error is now in prison in rhe City of St Louis under sentence of death for the murder of Arthur Preller in April lt85 The case was brought to this court upon a writ of error to the Supreme Court of Missouri and the deci sion here is upon a motion made by the Attornev eneral of that State to dismiss for want of jurisdiction This court is unable after a careful examination of the record to find that the plaintiff in enor has been de prived of any right privilege or immunity guaranteed to him bv tho Constitution of theUnited States an 1 the motion to dismiss for want of jurisdiction is therefore grouted The decision was announced by Chief Justice Waite and its effect is to aflirm the sentence of death pronounced by the State court The opinion of Chief Justice "Waite says that in Spies vs tbo State of Illinois it was held that to give this court jurisdiction under sec tion 70(t of the revised statutes of a denial by a State court of any title right privilege or immunity claimed under the Con stitution or any treaty or statute of the United States it must oh the record that such right title
