Although the mother wasn't injured in the accident, the child suffered permanent paralysis. Richard M. Goodman, the family's attorney in the case, argued that the 1964 Chevy II the mother was driving, and the baby seat the child was sitting in, were both unsafe. GOODMAN argued that the baby seat, manufactured by a firm which has since gone bankrupt, was not strong enough to stand up under the pressures of a crash and offered no restraint for child passengers. Goodman also argued that the front seat in the car should have had a lock on it to prevent the seat from springing forward in an accident.

Top Value Inc. was brought into the case because the child's family said it obtained the seat for the child from a Top Value redemption center. David Tyler, the attorney for Top Value in the case, argued that "the whole idea of crashworthiness was at an infantile stage" at the time of the accident. GENERAL MOTORS had not yet argued its case when the settlement was reached. The trial started before Wayne County Circuit Court Judge Charles Kaufman Feb.

1. The suit had been filed in 1970. Under the terms of the agreement, the child will receive $450,000 from Top Value and $175,000 from General Motors.
